The Content is protected under the law of England and Wales as well as other countries through international treaties.
Elements (“Elements”) of The Web Site are also protected by trade secret, trade dress, unfair competition, copyright as well as other laws and may not be imitated or copied in part or whole.
These Elements include custom icons, graphics, text, trademarks, service marks, trade dress (“Marks”) of Allfreight, third parties or affiliates of Allfreight.
You may not modify, lease, copy, reproduce, sell, loan, create derivative works from, transmit, upload, or distribute the Intellectual Property of The Web Site in any way without express permission in written form from Allfreight.
Allfreight does not grant to You by any means any express or implied rights to Allfreight’s or any third party or affiliates Intellectual Property.

Modifications

Allfreight reserve the right to make changes to or update The Terms of Use at any time. Your usage or continued usage of The Web Site after any such changes to The Terms of Use will mean You accept any and all of those changes. This includes but is not limited to any aspect of the site which may be changed, deleted, supplemented or updated without notice at the sole and complete discretion of Allfreight. Allfreight may also at any time impose fees or fines on products or services provided through The Web Site at Allfreight’s sole discretion. Allfreight may at any time change or establish general practices and limits concerning current or other Allfreight products and or services at its sole discretion.

Privacy Policy

The Privacy Policy (The “Privacy Policy”) governs the use of all information that is collected from and or provided by You via The Web Site. You agree that any information You provide, You have obtained all necessary consents for the processing of such personal information contemplated by the Services You are using, including the transfer of such data to England and Wales or other countries whose laws may not provide the same level of protection as the laws of the country of origin.

Protection of Customer Information

We understand the importance of privacy to our customers and visitors to The Web Site. For many years, our policy has been to treat what we learn about our customers as confidential. For example, we will not give or sell confidential or Personal Information (as described below) about our customer to any third party not affiliated with their transaction, except as required by law or as necessary to provide Allfreight services to the customer. 

We collect and store information about every package we handle so that we can efficiently provide the package delivery services demanded by our customers. We use information about our customers, their packages, and their shipping activity to provide or enhance the services we make available to our customers, communicate with our customers about additional services they may find of value, satisfy our legitimate business interests (including performing trend analysis and market studies), set prices, establish credit, fulfil a Contract of Carriage or Service Agreement, accomplish the billing function, and comply with government regulations. Although government regulations vary in the many countries in which we operate, they frequently include the reporting of information to transportation, safety, customs, and other regulatory agencies.

As we collect and use information about our customers, we may contract with vendors to assist us in processing that information for those purposes listed in the previous paragraph. These vendors are required to maintain the confidentiality of the information and are restricted from using the information for any other purpose. In addition, as Allfreight continues to develop its business, we may buy or sell subsidiaries or business units. As part of these transactions, customer information of the subsidiaries or business units may be one of the transferred assets.

Some of the information collected by Allfreight is data which relates to an identifiable person ("Personal Information"). Examples of Personal Information are names, addresses, e-mail addresses, credit card numbers and telephone numbers. We never sell information to third parties that could be used to specifically identify an individual customer or group of customers. Anonymized data, with all names, addresses and other Personal Information removed, is sometimes shared with third parties. Finally, we do provide Personal Information to government agencies as required by law or regulation.

In addition to the uses of the information described in the paragraphs above, we collect telephone numbers and e-mail addresses in the event that we have to contact the shipper, or the shipment recipient or addressee, to resolve a question or provide shipment status information.

Shipment Information

Information, including Personal Information, provided as part of a shipping transaction represents a record of that business transaction and cannot be altered after the transaction is complete except as provided in the these Terms and Conditions. Although we make reasonable efforts to limit access to our facilities and vehicles to authorized personnel, we are not responsible for maintaining the confidentiality of information that is printed and placed in plain view on a package or letter.

Security and Integrity of Information

We treat our data as assets that must be protected against loss and unauthorized access. We employ information security techniques to appropriately protect confidential information from unauthorized access by users inside and outside the company. Access to customer information is limited to those employees who have a legitimate business need for that information.

The Web Site, and their supporting systems, employ generally accepted information security techniques such as firewalls, access control procedures and cryptography to appropriately protect confidential information from unauthorized access.

Retention of Customer Information

We retain information, including Personal Information, about customers as necessary for business purposes and as required by government regulation. For example, we retain information about packages, including names and addresses, so that we can provide proof of delivery information and to process claim requests. We carefully dispose of records and delete information when retention periods expire.

What Information We Collect And How We Will Use It

Users can visit most areas of The Web Site without revealing who they are or providing any information about themselves. However, some of our interactive services require that users identify themselves in order to enable the interactive function. We may ask users to provide some Personal Information in these situations.

Cookies can make use of the web easier by saving and administering status, application, preferences and other user information. Web Surveys

From time to time, we include survey forms on The Web Site to better understand our customer’s needs and to create web sites that respond to their interests. Customers may opt-out of participating in follow-up surveys. Allfreight will not disclose survey response information to companies or individuals outside Allfreight with two exceptions:


1. Anonymized data, with all names, addresses and other personally identifiable information removed. 
2. To vendors who are required to maintain the confidentiality of the information and are restricted from using the information for any purpose other than helping to provide services to Allfreight or Allfreight customers.

Allfreight Web Site Applications

Users of Allfreight Internet Shipping and other applications on The Web Site that enable the purchase of products and services who choose to use credit cards for payment are required to provide information about themselves and their card. We use this information to establish credit for billing.

IP Addresses

The Web Site collects IP addresses for system administration, security, and statistical analysis purposes. An IP address is a number that is automatically assigned to a computer whenever it is connected to the Internet. We log these addresses and analyse them to understand where requests originate so that we can provide the most efficient service, enhance security, ensure appropriate usage and produce traffic volume statistics. 

My Account

In addition to the information provided, the following paragraphs describe our commitment to the protection of Personal Information as it applies to My Account, an interactive feature of Allfreight

Visitors to www.allfreight.co.uk can, if they choose, participate in the interactive functions available at My Account. Participants are required to complete a registration form. This form includes information such as name, address, phone number and e-mail address. We use the information from the registration form to enhance our services and better meet the needs and preferences of our customers. With approval, we may also send e-mails to registered users about Allfreight products, services and special offers that we think may be of interest. We allow registered users to choose to discontinue (opt-out) receiving such e-mails from Allfreight at any time by editing their My Account profile. There are certain e-mails that Allfreight may continue to send to registered users. For example, Allfreight uses e-mail to deliver information that registered users request. Allfreight also uses e-mail to provide details about customer account(s) and operational information regarding existing products, services and systems. 

My Account also includes an Address Book that allows users to enter the names and addresses of the people to whom they frequently ship packages or letters. Use of the Address Book is optional. It is provided as a convenience so that users will not have to re-enter frequently used address information. The address information provided is stored in a secure manner on Allfreight systems. While it is stored in the Address Book, we will carefully protect the confidentiality of this information. It will not be used for any purpose other than the original intent (i.e. speeding up user shipping activities).

Consent To Receive Certain E-Mails

My Account allows registered users to opt out of receiving e-mails regarding Allfreight products, services and special offers. Opting-out can be accomplished by editing the Profile in My Account and selecting the option labelled, "No, I prefer not to receive this type of e-mail from Allfreight." There are certain e-mails (as noted above under "My Account") that Allfreight may continue to send.

Review, Modification, and Deletion of Personal Information

Registered users in the My Account program can review, modify, or delete the information previously provided at the registration site by editing their Profile information in My Account. Review, add, and delete functions are also options within the Preferences and Address Book functions. Registered users should note that Allfreight will use reasonable efforts to delete user information when requested but that some residual information may remain because of backup files and deletion logs.

Expiration of Data

Personal information provided on the My Account registration form will be deleted if the user does not access My Account for 14 months.

Assent

Your continued use of this site signifies your assent to the Allfreight Privacy Policy. We reserve the right, at our discretion, to modify, add, or remove portions of this policy at any time by posting the revised policy at The Web Site. Please check this page periodically for changes.

The Allfreight Rate, Allfreight Tariff (to which extent is applicable to You) and Service Guide which is in effect at the time of shipment govern Your use of Allfreight transportation and related services obtained through The Web Site, which is in addition to any other terms and conditions that may be applicable to any such transaction as provided in The Web Site Terms of Use and any such Service Agreement(s). As such the Allfreight Rate, Tariff and Service Guide are hereby incorporated into The Terms of Use. All and any references herein to the Terms of Use will include to the extent applicable the Allfreight Rate, Tariff and Service Guide.

The Web Site restrictions of Use

In addition to other restrictions set out in The Terms of Use, You agree that:

(1) You will not mask or disguise the origin of any information transmitted via and or through The Web Site.
(2) You will not make, place or post misleading or false information on The Web Site.

(7) You may not access the Allfreight Systems, The Web Site or Services in any way that, in Allfreight’s judgment, adversely affects the function or performance of the Allfreight Systems, Information, Services, The Web Site or interferes with the ability of any authorised parties to access The Web Site, Services, Allfreight Systems or Information.
(8) You may not use techniques to frame or utilise framing to enclose any portion or aspect of the Content or the Information, without the express written consent of Allfreight.

1. Linking to any page of The Web Site is prohibited other than a link to our home page http://www.allfreight.co.uk unless you have a separate agreement with Allfreight stating so, exceptions to this are if the inbound link is provided by a search engine i.e. Google, Yahoo, Msn etc, or an online directory listing business services to the which are provided free of charge to the public.

Any device or web site which links to Allfreight is prohibited from replicating information or content, using a browser or any other software or device to border or frame the environment or content, implying in any fashion that Allfreight or any of its affiliates endorse it or its products, misrepresenting any facts including its or any relationship with Allfreight or any of the Allfreight affiliates, Services, Applications, Systems or Information, using any logo’s, Trademarks, images or intellectual property without the written permission of Allfreight, presenting or representing false information about Allfreight, its products or services.

Access to Information and shipping related information through The Web Site.

The “Shipping Related Systems” are comprised of the Allfreight Systems and other third party Systems, which are used to provide shipment locations, tracking, time in transit, address validation amongst other functions and information related to the despatch of items, boxes, parcels via Allfreight. The information gained from these systems (“Shipping Information”) is to be used by You or on Your behalf for no other purpose or reason other than for the purpose it was indented.
2. The Shipping Related Systems and Shipping Information are the property of Allfreight and other third parties. Allfreight authorises You to use The Shipping Related Systems solely to track consignments tendered by You or for You to Allfreight for the delivery, collection, storage or shipping and for no other purpose without the express written consent of Allfreight or third party to which the Software, Information or Application belongs.
3. You may not copy, share, store, transmit, sell, make public or distribute any Shipping Information unless it is for your sole use.
4. Any use of the Shipping Related Systems by any device which makes an automated inquiry, extraction of data, repetitive data gathering, routines, scripts or any other mechanisms with similar functionality to automate a request for information or content is prohibited

Submissions

Allfreight does not and will not accept ideas, techniques or concepts for new services, applications, software, information, content or products through The Web Site (“Comments”). If Comments are received, You acknowledge that they will not be considered confidential or proprietary. Allfreight and or its affiliates will be under no obligation to keep such information confidential and Allfreight and or its affiliates will have complete unrestricted, word-wide, irrevocable, royalty free right to use, reproduce, communicate, transmit, display, publish, distribute and exploit such Comments in any manner it sees fit.

Termination

You agree that Allfreight may suspend or terminate Your use if The Web Site, Allfreight Systems, Applications, Shipping Related Systems, Information, Content, Services at any time and for any or no reason at its sole discretion, even if use and access continues to be available or allowed to other people or entities. Online deposit

Deposits paid online through this website or the payment gateway website for products or services are non-refundable, deposits are taken to cover administration, card processing fees, card gateway processing fees, failed deliveries or collections and job space. Job space is where we have booked a collection or delivery and are then unable to take on another job at the same time or refuse another job based on the availability of space within our vehicles.

ALLFREIGHT MAKES NO REPRESENTATIONS ABOUT THE RESULTS TO BE OBTAINED FROM USING THE WEB SITE, THE ALLFREIGHT SYSTEMS, THE SERVICES, THE INFORMATION OR THE CONTENT. THE USE OF SAME IS AT YOUR OWN RISK.

You may not assign these Terms of Use or any of Your interests, rights or obligations under these Terms of Use. If any provision of these Terms of Use shall be found to be invalid by any court having competent authority, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms of Use, which shall remain in full force and effect. No waiver of any of these Terms of Use shall be deemed a further or continuing waiver of such term or condition or any other term or condition.

You may preserve these Terms of Use in written form by printing them for Your records, and You waive any other requirement for these Terms of Use to be proved by means of a written document.

EXCEPT AS EXPRESSLY PROVIDED FOR UNDER A SEPARATE LICENCE, SERVICE OR OTHER WRITTEN AGREEMENT BETWEEN YOU AND ALLFREIGHT OR IN THE APPLICABLE ALLFREIGHT RATE AND SERVICE GUIDE OR ALLFREIGHT TARIFF, THESE TERMS OF USE CONSTITUTE THE ENTIRE AGREEMENT BETWEEN YOU AND ALLFREIGHT WITH RESPECT TO THE USE OF THE WEB SITE, THE ALLFREIGHT SYSTEMS, AND ANY SOFTWARE OR SERVICE, INFORMATION AND CONTENT CONTAINED THEREIN, AND SUPERSEDE ALL DISCUSSIONS, COMMUNICATIONS, CONVERSATIONS AND AGREEMENTS CONCERNING THE SUBJECT MATTER HEREOF.

The parties declare that they have required that these Terms of Use and all documents related hereto, either present or future, be drawn up in the English language only.
